These Terms cover the auth-server account, Prepaid Pass and team invite purchases, and Berrynook VPN. Cloud workspace rules are in Cloud Terms. Berryporch has additional AUP rules. The App Store / Play Privacy Policy URL remains the Privacy Policy.

1. Agreement

These Terms are between you and Gray Whale and Blue Heron Co. (“we”, “us”). By creating an account, purchasing a Prepaid Pass or team round, or using Berrynook VPN / auth-server services, you agree to these Terms, the VPN Acceptable Use Policy, and the Privacy Policy.

2. Eligibility

Berrynook accounts are for adults 18 years of age or older. You must use a Proton sign-in address that you are allowed to hold under Proton’s terms. We do not offer Berrynook accounts for minors.

Accounts are Prepaid Pass and team invite accounts. Cloud workspace access (when provisioned) requires the VPN after production cutover.

3. The service

VPN — Encrypted tunnel via the Berrynook app (see also routing & leak protection)
Auth-server account — Sign-in, billing, devices, and password/email changes on our auth server
Cloud — Browser workspace at berrynook.cc when provisioned (separate Cloud Terms and Cloud Privacy)
Berryporch — Optional short browser calls (separate privacy and AUP)

Extra team Host storage is not offered to the public yet.

4. Refunds and prepaid time

Solo Prepaid Pass — Generally non-refundable once paid, except where required by law or Stripe/operator error (duplicate charge, failed delivery of Pass time). Contact help@berrynook.cc.
AUP / abuse suspension — Suspension or revocation for Acceptable Use violations is without refund.
Team round — Unused seats (invite revoked or expired before accept) are refunded automatically per product behavior; accepted seats follow Solo Pass rules.
Gift Pass — Held gifts that expire unused are refunded per product rules; once granted, same as Solo Pass.
Account deletion — Deleting your account does not by itself create a refund of unused Pass time unless a product path says otherwise; you may keep prepaid time for a comeback window when offered at deletion.

5. Acceptable use

You must follow the VPN Acceptable Use Policy. We may suspend or revoke access as described there.

6. Availability and disclaimer

The service is provided “as is” without warranties of uninterrupted or error-free operation, to the fullest extent permitted by law.

7. Limitation of liability

To the fullest extent permitted by law, Gray Whale and Blue Heron Co. is not liable for indirect, incidental, or consequential damages arising from use of the service. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Changes

We may update these Terms. The “Last updated” date and published URL will change. Material changes may be communicated via email or in-app notice.

9. Governing law

These Terms are governed by the laws of British Columbia, Canada. Courts of British Columbia have exclusive jurisdiction, unless mandatory local law requires otherwise.
