These Terms cover the auth-server account, Prepaid Pass and team invite purchases, and Berrynook VPN. Cloud workspace rules are in Cloud Terms. Berryporch has additional AUP rules. The App Store / Play Privacy Policy URL remains the Privacy Policy.

These Terms are between you and Gray Whale and Blue Heron Co. (“we”, “us”). By creating an account, purchasing a Prepaid Pass or team round, or using Berrynook VPN / auth-server services, you agree to these Terms, the VPN Acceptable Use Policy, and the Privacy Policy.
Berrynook accounts are for adults 18 years of age or older. You must use a Proton sign-in address that you are allowed to hold under Proton’s terms. We do not offer Berrynook accounts for minors.
Accounts are Prepaid Pass and team invite accounts. Cloud workspace access (when provisioned) requires the VPN after production cutover.
Extra team Host storage is not offered to the public yet.
You must follow the VPN Acceptable Use Policy. We may suspend or revoke access as described there.
The service is provided “as is” without warranties of uninterrupted or error-free operation, to the fullest extent permitted by law.
To the fullest extent permitted by law, Gray Whale and Blue Heron Co. is not liable for indirect, incidental, or consequential damages arising from use of the service. Nothing in these Terms limits liability that cannot be limited under applicable law.
We may update these Terms. The “Last updated” date and published URL will change. Material changes may be communicated via email or in-app notice.
These Terms are governed by the laws of British Columbia, Canada. Courts of British Columbia have exclusive jurisdiction, unless mandatory local law requires otherwise.
